In the context of this processing, we are joint controllers pursuant to Art. 26 DSGVO (FACT GmbH Wirtschaftsprüfungsgesellschaft, FACT Steuerberatungsgesellschaft mbH and FACT Rechtsanwaltsgesellschaft mbH). The joint processes relate in particular to the operation and use of jointly used databases, platforms and IT systems.
To this end, we have set out in a joint responsibility agreement how the respective tasks and responsibilities for processing personal data are structured and who fulfils which data protection obligations. In particular, we have determined how an appropriate level of security and your data subject rights can be ensured.
Purpose of data processing
The purpose of data processing is the initiation of employment relationships on the basis of Art. 88 Para. 1, Art. 6 Para. 1 b) EU-DSGVO, § 26 BDSG. Data will not be passed on to other companies.
Categories of recipients
Applicants' data is not passed on to third parties. Since we use service companies for our information technology that are separately committed to confidentiality and data protection, access to personal data in this context cannot be excluded. Categories of recipients outside the business and personnel management are service providers for hosting and support. Data is only passed on to public authorities in the event of overriding legal provisions. A transfer to third countries does not take place.
Duration of storage and deletion of data
Your data will be stored for the duration of the application process; after a decision has been made on your application or after the position has been awarded, the data will be stored for 6 months; in the case of unsolicited applications or your consent to store the data for longer for possible future employment, for a maximum of two years.
Your right to information, correction, deletion, objection and data portability
You can exercise your right to information, correction and deletion of data at any time. To do so, please contact us via the channels described above. If you wish your data to be deleted, we will delete the data after expiry of the limitation periods. However, if we are still legally obliged to retain the data, access to your data will be restricted (blocked). The same applies in the event of an objection. You can exercise your right to data portability insofar as the technical possibilities are available to the recipient and to us.
